Uncontested Divorce (Ontario / Canada)

A contested divorce arises where spouses cannot agree on one or more material issues, such as:

  • division of property (including the matrimonial home and equalization of net family property);
  • parenting issues (decision-making responsibility and parenting time);
  • child support; and/or
  • spousal support.

When a matter is contested, the court process may involve conferences, motions, disclosure obligations, and, if settlement is not achieved, a trial. The court ultimately determines the unresolved issues based on the evidence and the applicable legislation.
