Spousal Support
Spousal support is intended to address the financial consequences of a relationship breakdown. It may be temporary or ongoing, and it can be resolved by agreement or court order. Spousal support is distinct from child support.
Entitlement (When spousal support may apply)
Spousal support may be available where a spouse can establish one or more of the following bases:
- Compensatory: Recognizes economic disadvantages or lost opportunities arising from the relationship or its breakdown (for example, time out of the workforce to support the family).
- Needs-based (non-compensatory): Addresses ongoing financial need and significant disparity in living standards after separation.
- Contractual: Based on a domestic contract such as a marriage contract or separation agreement.
