Service Outside Canada (Hague Service Convention)
If a spouse must be served with divorce materials outside Canada, special service rules may apply. Where the receiving country is a party to the Hague Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters (the “Hague Service Convention”), documents are typically served through the Convention’s prescribed channels to ensure service is valid and can be relied on in the Ontario proceeding.
India is a signatory to the Hague Service Convention. If the respondent spouse is located in India, service generally must be completed in accordance with Hague requirements and local procedural steps, which can affect timelines.
