Uncontested Divorce (Ontario / Canada)
An uncontested divorce generally means both spouses agree that the marriage has broken down and there are no outstanding issues requiring a judge’s decision. Because the court is not being asked to resolve disputes, uncontested divorces are typically more streamlined and cost-effective than contested proceedings.
Where the parties have already resolved the key terms of separation—often in a written Separation Agreement addressing parenting arrangements (decision-making responsibility and parenting time), child support, spousal support, and property division—the divorce application can usually proceed without significant litigation. In some cases (for example, shorter marriages or circumstances with no property or support issues), an uncontested divorce may proceed without a comprehensive agreement, provided there are no unresolved claims.
